1. Assumption of Risk
Archery and related activities involve inherent risks, including serious injury, permanent disability, or death. These risks may arise from equipment use, the actions of other participants or spectators, environmental conditions, or other known and unknown factors.
I voluntarily assume all such risks, whether caused by negligence or otherwise, to the fullest extent permitted by law.
2. Controlled Equipment & Conduct
I understand that Primal Archery equipment is a controlled weapon and must only be used as instructed. I agree to follow all staff directions and posted rules. Misconduct, inappropriate behaviour, or misuse of equipment may result in removal from the premises without refund.
3. Release and Indemnity
To the fullest extent permitted by law, I release and hold harmless Primal Archery, its owners, directors, employees, volunteers, agents and representatives from liability for injury, death, loss or damage arising from participation in activities at the facility, including where caused by negligence, except where liability cannot legally be excluded.
This release is binding on me, my heirs, executors, administrators and assigns.
4. Personal Responsibility
I confirm that I am medically fit to participate. I understand that Primal Archery is not responsible for lost, stolen, or damaged personal belongings and that securing personal items is my responsibility. I consent to video surveillance on the premises for safety and operational purposes.
5. Photography & Media
Primal Archery may take photographs or video recordings during sessions for social media, marketing, and promotional purposes. If you do not wish to appear in photos or videos, please inform staff at the time and we will respect your request. We will always seek parent or guardian permission before photographing or filming dependents.
6. Validity
This waiver remains valid for 12 months from the date of signing unless revoked in writing.
7. Severability and Governing Law
If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement is governed by the laws of Western Australia and any disputes shall be subject to the jurisdiction of Western Australia.
8. Confirmation and Legal Acknowledgement
By signing below, you confirm that you have read, understood, and voluntarily agree to this Waiver. You acknowledge the risks involved and understand that you are waiving certain legal rights. You agree that your electronic signature and digital confirmation constitute a valid and binding signature under applicable Western Australian electronic transactions legislation. You further agree to comply with Primal Archery Terms and Conditions (available on-site and at primalarchery.com.au/terms), which are incorporated into this agreement.
